Hijacking the Courts?
There is something very consistent among the reports in the mainstream media about the Alito nomination. It reveals the disconnect between liberal academia, politics, and media and many in America. Abortion, what I believe is murder, and what the constitution designates a state-decided issue was legalized--no, not just legalized but made a right available to all--by a non-legislative, unelected, and unaccountable branch of government. Any judge nominated will either ultimately decide that a woman has the right to terminate the life of her unborn child or the judge will decide that that right is not able to be granted arbitrarily by the court. The constitution is mute on that point.
A consistent assumption in all stories is that any judge that may rule that abortion at all stages of a pregnancy for any reason is not a right is a divisive nomination. Conservatives are being accused of “hijacking” the courts to be used to take away rights. At the polls, America has demonstrated time and time again that conservative ideology wins. The two elected branches of government, executive and legislative, have been rather consistently conservative for decades. The liberals have rules from the courts, transforming them into an unstoppable legislative force. For years, the triumvirate branch system in government—set up to allow for checks and balances—has been unable to stop the rogue courts. Finally, the democratic process has caught up with the courts. No more legislative judiciaries. The hijacked courts are being taken back and the liberals are crying that they are being hijacked. Nope they are being freed.
This appointment is not about abortion. This appointment is about judicial principles. Because the constitution is silent on the abortion the courts should be as well. The only statement the courts should make on abortion is, “We cannot speak. The constitution is silent. Let the states and the elected officials decide.” That is the way this nation was founded.
Herein lies liberal’s fears. If it is up to the people to decide on abortion, abortion will surely be limited. Therefore any judge that will put the power to enact laws into the hands of people elected and held accountable by people is seen as a divisive judge.
In this nomination, I am more proud of the President than I have been at any other time in his presidency. The people elected a conservative President and conservative Congress because the people believe in conservative ideals. So let’s use this chance as a chance to give elected officials the ability to enact laws without them being trumped by rogue judiciaries. If the majority decide that abortion is a right they will vote for state legislatures that will pass laws to extend that right. If they decide that homosexual marriage is appropriate, they will elect representatives to allow it. Ultimately even a Supreme Court decision against abortion will not be a decision against abortion, it will be a decision to let the people decide.
It has appeared that Bush felt that if he compromised with the left they would love him. Well that’s proven itself wrong time and time again. So finally, 6 years into his Presidency he has decided to act strongly, at appears, on what he was elected to do.
